Please read these Terms of Service carefully before placing an order or using this store. By completing a purchase, you agree to be bound by these terms.
1. Who You Are Contracting With
This store is operated by Hot Cake Holdings Ltd (“Hot Cake”, “we”, “us”, “our”), a company registered in England and Wales. Hot Cake acts as merchant of record for all transactions processed through this store and is your contracting party for all purchases made here.
This store is published on behalf of Overmono (“the Artist”). Hot Cake operates the store under licence from the Artist and is responsible for all order fulfilment, customer service, and after-sales support. The Artist is not a party to your purchase contract.

2. Eligibility
By placing an order, you confirm that:

We reserve the right to cancel orders where we have reason to believe eligibility requirements have not been met.
3. Products and Pricing
Pricing
All prices are displayed in the currency shown at checkout and are inclusive of applicable VAT where required. We reserve the right to update prices at any time. The price applicable to your order is the price displayed at the time you place it.
In the event of a clear pricing error, we reserve the right to cancel your order and issue a full refund. We will notify you promptly if this occurs.
Product descriptions
We take reasonable care to ensure product descriptions and images are accurate. However, product images are for illustrative purposes only. Minor variations in colour, print placement, or finish may occur due to the nature of garment and print manufacturing. These variations do not constitute a fault.
Availability
All products are subject to availability. We reserve the right to withdraw any product from sale at any time without notice. In the event that a product becomes unavailable after your order has been placed, we will contact you to offer an alternative, a store credit, or a full refund.
4. Orders and Contract Formation
Placing an order constitutes an offer to purchase. A binding contract between you and Hot Cake Holdings Ltd is formed only when we dispatch your order and send you a dispatch confirmation. An order confirmation or payment receipt email does not constitute acceptance of your order.
We reserve the right to decline or cancel any order at our discretion, including where:

We are unable to verify payment or delivery details

We have reason to suspect fraudulent activity
If we cancel your order, any payment taken will be refunded in full.
5. Pre-Orders and Limited Editions
Pre-orders
Where a product is listed as a pre-order, payment is taken at the time of purchase. The estimated dispatch date shown is an estimate only and is not a guaranteed delivery date. Manufacturing timelines can be subject to change.
If a pre-order is delayed beyond a reasonable period, we will notify you and provide the option to cancel for a full refund. If you do not cancel, your order will be fulfilled as soon as the product is available.
Limited edition and made-to-order items
Limited edition and made-to-order products are produced specifically in response to demand. These items are non-returnable and non-exchangeable unless faulty or incorrectly supplied. Please check sizing and product details carefully before purchasing.
6. Payment
We accept the payment methods displayed at checkout. All transactions are processed securely via Shopify Payments and/or third-party payment providers including Stripe and PayPal. Hot Cake does not store your full card or payment details.
Payment must be received in full before an order is processed. Where a payment is declined or reversed after dispatch, we reserve the right to pursue recovery of the outstanding amount.
For queries about payment disputes, please refer to our Refund Policy and contact us before initiating a chargeback. We provide full tracking, delivery confirmation and order records to payment providers as part of any dispute process.
7. Shipping and Delivery
Estimated delivery timeframes are shown at checkout and are provided in good faith. They are estimates only and are not guaranteed delivery dates. We are not liable for delays caused by carriers, customs authorities, or events outside our reasonable control.
Risk in the goods passes to you on dispatch. Once your order has been handed to the carrier and a tracking number issued, responsibility for the shipment transfers accordingly.
International orders
For deliveries outside the UK, your order may be subject to import duties, taxes, and customs clearance fees imposed by the destination country. These charges are the responsibility of the recipient and are not included in our pricing. We are unable to advise on the specific charges applicable in your country as these vary by jurisdiction.
Failed deliveries
If a parcel is returned to us due to an incorrect address or failed delivery attempts, we will contact you to arrange re-dispatch. Additional shipping charges may apply. We are not responsible for parcels returned due to customer error in providing delivery details.
8. Returns and Refunds
Our full returns and refunds process is set out in our Refund Policy, which forms part of these Terms of Service. Please read it carefully before placing an order.
Nothing in our Refund Policy affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013, including your right to cancel a standard order within 14 days of receipt without giving a reason.
9. Intellectual Property
All artwork, designs, logos, brand names, photography and other creative content displayed on this store are the intellectual property of the Artist or their respective licensors. Hot Cake uses this material under licence for the purposes of operating this store.
You may not reproduce, copy, distribute, modify, or commercially exploit any content from this store without the prior written consent of the relevant rights holder. Purchase of a product does not transfer any intellectual property rights to you beyond the physical item itself.
10. Limitation of Liability
To the fullest extent permitted by law:

Hot Cake is not liable for any indirect, consequential, or special losses arising from your use of this store or purchase of products

Our total liability to you in connection with any order shall not exceed the total value of that order

We are not liable for losses arising from events outside our reasonable control, including but not limited to carrier delays, customs delays, or force majeure events
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
11. Your Statutory Rights
Nothing in these Terms of Service affects your statutory rights as a consumer under English law, including your rights under:

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 — including the right to cancel within 14 days of receiving your order

You agree not to use this store for any unlawful purpose or in any way that could damage, disable, or impair the store or interfere with other users. We reserve the right to refuse service, cancel orders, or block access where we reasonably suspect misuse or fraudulent activity.

Your use of this store is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By placing an order, you acknowledge that you have read and understood our Privacy Policy.

15. Governing Law
These Terms of Service are governed by the laws of England and Wales. Any disputes arising in connection with these terms or your use of this store shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection law in your country of residence requires otherwise.
